Welcome to the website of MCDescollines Avocate (hereinafter “MCDescollines”, “we”, “us” or “our”), available at mcdescollines.com.

By accessing our site or using our services, you acknowledge that you have read, understood and accepted these terms of use in their entirety, together with our privacy policy and our legal notice. If you do not accept these terms, we invite you not to use our site or our services.

Description of services

MCDescollines Avocate provides legal services to individuals, businesses and institutions from its Sherbrooke and Quebec City offices, including:

• Consultations and legal opinions
• Representation before the courts and administrative tribunals
• Drafting, reviewing and negotiating legal documents
• Guidance and follow-up on your file, from the first meeting through to its conclusion

Our fields of practice are set out on the practice areas page. All our services are provided by lawyers who are members in good standing of the Barreau du Québec.

Legal capacity and eligibility

Use of our services is reserved for persons having the legal capacity to contract under Quebec law. By using our services, you represent that you:

• Are at least 18 years of age, or are represented by a parent or legal guardian
• Have the legal capacity required to enter into an agreement
• Provide accurate, complete and up-to-date information

Nature of the professional relationship

The general information published on our site (including the practice area pages, the frequently asked questions and the information portal) is provided for guidance only. It does not constitute legal advice and is no substitute for a personalized consultation with a lawyer.

Fees and payment

The fees, disbursements and billing terms specific to your file are established with you and set out in a written fee agreement signed before the mandate begins.

• A retainer may be required and is deposited in trust, in accordance with the rules of the Barreau du Québec
• Applicable taxes (GST and QST) are added to the agreed amounts, unless otherwise indicated
• No rates are published on this site: fees vary with the nature, complexity and stage of the file

Should you disagree with fees billed to you, you may seek conciliation and arbitration of accounts through the Barreau du Québec.

User obligations

By using our site and our services, you undertake to:

• Provide truthful, complete and up-to-date information
• Use our services for lawful purposes only
• Not impersonate any third party
• Not send confidential or sensitive information through the contact form before a mandate has been confirmed — if we represent a party with interests opposed to yours, we may be required to disclose to our client any information you provide to us
• Respect the confidentiality of the exchanges and documents you receive
• Not attempt to compromise the security or integrity of the site
• Not reproduce, distribute or exploit the content of the site without written authorization

Confidentiality and professional secrecy

Exchanges between you and a lawyer of MCDescollines Avocate in the course of a mandate are protected by the professional secrecy recognized by the Professional Code and the Charter of Human Rights and Freedoms of Quebec.

The processing of your personal information is governed by our privacy policy, which forms an integral part of these terms.

Intellectual property

All content on the site — text, images, logos, layouts, graphics and code — is the exclusive property of MCDescollines Avocate or its licensors, and is protected by Canadian and international intellectual property laws.

Any reproduction, modification, distribution or commercial use without prior written authorization is strictly prohibited.

Limitation of liability

MCDescollines Avocate undertakes to provide its services with professionalism, diligence and in accordance with the ethical rules of the Barreau du Québec.

Governing law and jurisdiction
